User Agreement

01Acceptance of these terms

By creating a wallet, importing an existing one, or otherwise using Jaxx Liberty (the "App"), you agree to be bound by this User Agreement (the "Terms"). If you do not agree, do not create or import a wallet and do not use the App.

These Terms apply to the version of the App you are using and to any updates, unless a replacement agreement is presented to you at that time.

02What Jaxx Liberty is

Jaxx Liberty is client-side software that lets you generate, import, encrypt, and use cryptographic key pairs for supported public blockchains — including Bitcoin, Ethereum, Solana, Polygon and BNB Chain — directly on your own device. The App reads on-chain data from and submits signed transactions to these public networks.

Jaxx Liberty is not a bank, broker, exchange, custodian, or money transmitter. It does not hold, pool, lend, or have access to your funds at any point. Every balance you see belongs to an address on a public, decentralized network that Jaxx Liberty does not operate or control.

03Eligibility

You must be able to form a binding contract to use the App, and you must comply with the laws that apply to you, including any rules about owning or transacting in digital assets in your country or region.

You are solely responsible for determining whether your use of the App is lawful where you live, and for meeting any tax obligations arising from your on-chain activity.

04Your keys and password

When you create or import a wallet, Jaxx Liberty encrypts your secret key or recovery phrase using a password you choose, and stores only that encrypted data on your device. Your password is never transmitted anywhere and is not recoverable by Jaxx Liberty.

• You are responsible for choosing a strong password and keeping it confidential.
• You are responsible for keeping your device secure, including protecting it from malware and unauthorized physical access.
• You are responsible for downloading and safely storing the encrypted backup file offered by the App.

Anyone who obtains your password together with your encrypted wallet, or your recovery phrase directly, can take full and irreversible control of the associated funds.

05No custody, no recovery

Because Jaxx Liberty never receives your password or your unencrypted keys, it has no ability to view your funds, freeze an address, reverse a transaction, or reset a forgotten password.

If you lose your password and do not have a working backup, or if you lose your backup and forget your password, the associated funds are permanently inaccessible. This is a structural property of self-custody wallets, not a defect, and it applies regardless of how the loss occurred.

06On-chain transactions

Payments you submit through the App are broadcast to the relevant blockchain and, once confirmed, are final and cannot be reversed, cancelled, or recalled by Jaxx Liberty or anyone else.

• You are responsible for verifying the destination address, network, amount, and any required memo or tag before confirming.
• Sending funds to an incorrect address, or on the wrong network, can result in permanent loss of those funds.
• Network fees are set by each blockchain's own fee mechanism, not by Jaxx Liberty, and are shown to you before you confirm.

07Risks you accept

Using a self-custody wallet and holding digital assets involves risks beyond those of traditional financial products. By using the App, you acknowledge and accept the following, among others:

• Price volatility. The value of digital assets can fluctuate significantly and may fall to zero.
• Irreversibility. On-chain transactions cannot be undone once confirmed.
• Phishing and social engineering. No legitimate request will ever ask for your password or recovery phrase; treat any such request as an attempted theft.
• Software and device risk. Bugs, browser vulnerabilities, malware, or device failure could affect the App or your access to your funds.
• Network risk. Supported blockchains are operated by independent participants outside Jaxx Liberty's control; outages or protocol issues are outside Jaxx Liberty's control.

Nothing in the App constitutes financial, investment, tax, or legal advice.

08Acceptable use

You agree not to use the App to:

• Violate any law, regulation, or third party's rights, including sanctions and anti-money-laundering rules that apply to you;
• Send, receive, or facilitate funds you know or suspect to be connected with fraud, theft, or other illegal activity;
• Attempt to disrupt, maliciously reverse-engineer, or interfere with the App's normal operation or any supported network;
• Misrepresent your identity or affiliation in connection with the App.

09Backups and local data

The App stores your encrypted wallet data locally on your device (or in browser-provided storage available to the App). Clearing your browser data, uninstalling the App, or switching devices without first exporting and safely storing a backup may make your wallet permanently inaccessible.

You are solely responsible for maintaining your own backups and for testing that you can restore from them before you rely on the App to hold meaningful value.

10Intellectual property

The App's design, text, and code, excluding open-source components and the public blockchains themselves, belong to Jaxx Liberty or its licensors. You may use the App for its intended personal purpose; you may not copy, resell, or redistribute it except as permitted by its open-source license, if any.

11No warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, to the fullest extent permitted by law.

Jaxx Liberty does not warrant that the App will be uninterrupted, error-free, or secure, or that any supported network will be available at any given time.

12Limitation of liability

To the fullest extent permitted by law, Jaxx Liberty and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, data, or goodwill, arising from or related to your use of the App, even if advised of the possibility of such damages.

Because Jaxx Liberty never has access to your keys or funds, it has no ability to prevent, mitigate, or reverse losses arising from lost passwords, lost devices, mistaken transactions, or third-party attacks such as phishing.

13Indemnification

You agree to indemnify and hold harmless Jaxx Liberty and its team from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or third-party right.

14Changes to these terms

Jaxx Liberty may update these Terms from time to time to reflect changes to the App or for legal or operational reasons. Material changes will be presented to you for review before they take effect. Continuing to use the App after an update means you accept the revised Terms.

15Availability

Because Jaxx Liberty does not hold your funds or maintain user accounts on a server, there is no central account for it to suspend or terminate. Jaxx Liberty may, however, stop distributing, supporting, or updating the App at any time. Your wallet and its funds remain under your control on-chain regardless of the App's availability, provided you retain your password and/or backup.

16Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App will be resolved in the courts of Wilmington, Delaware, unless applicable law requires otherwise.
